Major Abortion Dispute Heads to Supreme Court: Mail-Order Access to Mifepristone at Risk
The manufacturer of mifepristone, Danco Laboratories, has appealed for the Supreme Court's intervention in an appellate court ruling that threatens mail-order access to the drug. This comes in light of last year's overturning of Roe v. Wade and subsequent restrictions on abortion across various states.
The Supreme Court of the United States is being petitioned to reverse an appellate ruling that threatens to terminate mail-order access to mifepristone, a drug used in the most prevalent method of abortion in the country. This case emerges as the first major abortion disagreement brought before the Supreme Court since it overturned Roe v. Wade last year.
Roe v. Wade Overturned and its Consequences

The overturning of Roe v. Wade has led to prohibitions on abortions at all stages of pregnancy in 15 states, with some exceptions. Furthermore, abortions are banned once cardiac activity can be detected, which is around six weeks gestation period, in two other states.
Danco Laboratories Appeals
In an appeal lodged on Friday, Danco Laboratories based out of New York – the manufacturer of mifepristone – argued that federal judges should not question or overrule the Food and Drug Administration's (FDA) approval of this drug or interfere with conditions under which it is dispensed.
Biden Administration Expected To Appeal
It was also anticipated that Biden administration would file an appeal against this ruling. The federal appeals court verdict in August could potentially revoke approval for dispensing mifepristone through mail orders and reduce from ten weeks down to seven weeks, the time frame within which this drug can be used during pregnancy.
Previous Intervention by Justices
In April earlier this year, justices had intervened in this case ensuring availability of mifepristone while legal challenges continue their course through federal courts.
