SpaceX in Hot Water: Accused of Unlawful Employee Termination Over Elon Musk Criticism

The National Labour Relations Board accuses SpaceX of illegally terminating employees who criticized CEO Elon Musk and suggests surveillance of worker activities.

In a significant development, a US labor agency has filed a complaint against SpaceX, accusing the aerospace company of unlawfully firing employees who expressed criticism of CEO Elon Musk in an open letter. The complaint, filed by a Los Angeles-based regional director for the National Labour Relations Board (NLRB), consolidates eight unfair labor practice charges against SpaceX.

SpaceX Under Fire: Musks Company Accused of Silencing Critics

Background: The Open Letter and Employee Concerns

The cases stem from SpaceX's alleged actions following the circulation of an open letter by employees in June 2022. The letter raised concerns about workplace issues and called on executives to address Musk's public behavior on Twitter, which was then known as X. The employees expressed discomfort with Musk's handling of sexual harassment allegations against him, which he denied. The letter also referred to Musk's actions as a frequent source of distraction and embarrassment.

Employee Terminations and Alleged Surveillance

Following the circulation of the letter, nine employees were terminated for their involvement. In addition to the firings, the NLRB complaint alleges that SpaceX engaged in further unfair labor practices. These include interrogating employees about the letter, announcing that employees were terminated for their participation, and inviting employees to quit if they disagreed with Musk's behavior. The complaint also alleges that some employees were shown screenshots of communications between employees about the letter, creating an impression that their protected concerted activities were under surveillance.

SpaceX's Response and Next Steps

SpaceX has not yet responded to requests for comment on the NLRB complaint. The company has until mid-January to respond to the allegations. If a settlement is not reached, a hearing is scheduled to begin on March 5 in Los Angeles. The NLRB's complaint marks the first step towards litigating these allegations and seeking a resolution.

The NLRB's complaint against SpaceX highlights the importance of protecting employees' rights to express concerns about workplace issues and engage in protected concerted activities. The outcome of this case will have implications for employee rights and labor relations in the tech industry and beyond.
