Post-Strike Panic or Calculated Crime? Pakistan’s LoC Shelling Targets Innocent Civilians in Kashmir

In a highly disturbing escalation following India's precision anti-terror strike "Operation Sindoor," the Pakistan Army has resorted to ruthless artillery shelling against innocent civilians along the Line of Control (LoC) in Jammu & Kashmir. This act, clearly calculated and malicious, has claimed 15 civilian lives and left 59 others severely injured, including two Central Reserve Police Force (CRPF) personnel, predominantly affecting Poonch, Tangdhar, and Uri.

The devastation is undeniable and deliberate. Villages devoid of any strategic military importance have been relentlessly bombarded, leaving innocent lives taken, homes shattered, infrastructure destroyed, and communities grieving. Such calculated aggression showcases Pakistan's willingness to use innocent civilians as pawns in its geopolitical gambles, reflecting sheer disregard for human dignity and international law.

Pakistan Targets Innocents

According to defence analysts and strategic affairs experts, the Pakistani Army directly and deliberately targeting Indian civilians is not only a human rights violation but also constitutes a war crime. Targeting civilians during armed conflict is explicitly prohibited under the Geneva Conventions, specifically under the Fourth Geneva Convention (1949) and its Additional Protocol I (1977). These international laws mandate adherence to the principle of distinction, which requires parties involved in a conflict to differentiate clearly between combatants and civilians, ensuring that only legitimate military targets are attacked.

Pakistan has violated these fundamental principles by targeting innocent civilians amid ongoing military escalation between India and Pakistan, following the dastardly Pakistani terror attack at Pahalgam that killed 26 tourists. India, exercising its legitimate right to self-defence, responded by striking terrorist headquarters and camps inside Pakistan.

Pakistan's brazen violation of the Fourth Geneva Convention, particularly Common Article 3, cannot be overstated. The indiscriminate targeting of civilian populations explicitly breaches the principles of distinction and proportionality fundamental to international humanitarian law. Military experts have warned that these acts align closely with cases prosecuted as war crimes by international bodies, notably the International Criminal Tribunal for the former Yugoslavia (ICTY).

India has responded swiftly, focusing on humanitarian relief, evacuating the affected population, and extending urgent medical assistance. Concurrently, diplomatic channels are working overtime to highlight Pakistan's egregious violations globally, pushing the international community to hold Islamabad accountable.

The near miss involving a United Nations facility in Poonch amplifies the seriousness of Pakistan's irresponsible actions, necessitating immediate and decisive global intervention. It is imperative that international bodies and human rights organisations confront Pakistan firmly, ensuring that this calculated aggression and blatant war crime do not go unpunished. To allow such crimes to pass unchecked risks emboldening further dangerous military adventurism, endangering more innocent lives in the region.
