The Constitutional Council's decision followed the Supreme Court's rejection of Sonko's appeal against his defamation conviction. The trial stemmed from a lawsuit filed by a government minister, and the opposition leader viewed it as part of a prolonged legal battle aimed at thwarting his presidential bid in the upcoming February elections. Sonko's lawyer, Khoureychi Ba, expressed disappointment and acknowledged that his opponents had succeeded in eliminating him from the race.

Sonko's Political Challenges

Sonko, who came third in Senegal's 2019 presidential election, is widely regarded as the primary challenger to President Macky Sall's ruling party. Sall ultimately decided against seeking a third term after Sonko's supporters engaged in months of protests, some of which turned deadly. While the Constitutional Council's decision is unrelated to Sonko's defamation conviction, it holds the final say on all candidacies, including that of the opposition leader. Under Senegal's electoral code, a conviction of this nature renders an individual ineligible for the presidential race.

Sonko is currently serving a six-month suspended prison sentence for the defamation conviction. El-Hadji Diouf, the lawyer representing the minister who filed the defamation suit, celebrated the court's ruling as a significant victory for the minister's legal team. Diouf expressed satisfaction with the upheld sentence and celebrated their triumph.

Legal Battles and Political Turmoil

Sonko's presidential bid has been marred by a series of legal challenges. In 2021, he was accused of rape, but was acquitted in June. However, he was convicted of corrupting youth and sentenced to two years in prison, sparking nationwide protests. Senegalese authorities dissolved Sonko's political party in late July and detained him. Despite overcoming a significant legal hurdle in December, Sonko's candidacy remains uncertain.
