OpenAI Countersues Elon Musk, Defending Shift to For-Profit Model
OpenAI, the creator of ChatGPT, has responded to a lawsuit from Elon Musk, asserting its commitment to the beneficial development of artificial general intelligence (AGI) while addressing concerns about its pursuit of profits. The company released emails from Musk and vowed to dismiss all of his claims.
In response to a lawsuit filed by Elon Musk, OpenAI, the creator of ChatGPT, has defended its decision to become a for-profit company. Musk, who was an early investor and co-chair of OpenAI's board, alleges that the company betrayed its founding goal of benefiting humanity by pursuing profits instead. OpenAI, however, maintains that the transition was necessary to secure sufficient resources to compete with tech giants like Google.

OpenAI's Response to Musk's Lawsuit
In a blog post published on Tuesday, OpenAI vowed to dismiss Musk's claims and released emails between Musk and company leaders discussing the possibility of becoming a for-profit entity. The company emphasized its mission to ensure that artificial general intelligence (AGI) benefits all of humanity, which includes developing safe and beneficial AGI and promoting broadly distributed benefits.
Musk's Funding and OpenAI's Fundraising
Musk's lawsuit alleges that he secured an agreement for OpenAI to remain a nonprofit when he provided funding during its launch. However, OpenAI clarified that while Musk invested less than $45 million, the company has raised over $90 million from other donors. OpenAI maintains that the vast amounts of computing power required to build AGI necessitated the transition to a for-profit model.
Discussions and Disagreements
OpenAI revealed discussions with Musk where he demanded to become CEO, majority shareholder, and have control of the board. However, the company executives believed that no single person should have absolute control. Musk also suggested merging OpenAI with Tesla to leverage Tesla's financial strength to compete with Google's AI efforts, but this proposal did not materialize.
OpenAI's Stance on Open-Source Code
Musk further argues that OpenAI broke its promise to keep its code open to the public. OpenAI countered this claim by presenting an email from chief scientist Ilya Sutskever, who expressed concerns about the potential misuse of open-source code by unscrupulous actors. Musk responded in agreement, acknowledging the importance of not sharing certain scientific knowledge.
Musk's Reaction and Ongoing Legal Battle
In response to OpenAI's blog post, Musk took to his social media platform, X, formerly known as Twitter, demanding a name change to "ClosedAI" in exchange for dropping the lawsuit. The law firm representing Musk has not yet responded to requests for comment. The legal battle between Musk and OpenAI continues, with OpenAI determined to dismiss the claims and Musk seeking to enforce his alleged agreement for OpenAI to remain a nonprofit.
The dispute between Elon Musk and OpenAI highlights the complex challenges surrounding the development and commercialization of artificial intelligence.
