California Man Sentenced for Assisting Pregnant Chinese Women in US Birth Tourism Scheme
A California resident has been sentenced to nearly three and a half years in prison for orchestrating a scheme that facilitated travel for pregnant Chinese women to the U.S. to give birth, granting their children American citizenship. Michael Wei Yueh Liu, aged 59, was convicted of conspiracy and money laundering for his role in the business known as USA Happy Baby.

Liu's wife, Phoebe Dong, who is now separated from him, was also found guilty in connection with the operation and is expected to be sentenced next year. Liu received a 41-month sentence and was taken into custody after the hearing. He briefly held Dong's hand as she cried before being led away by authorities.
Family Impact and Courtroom Plea
During the court proceedings, Liu requested leniency, citing his responsibilities towards his elderly parents and 13-year-old son. "My intent was always to uphold the values of integrity and responsibility," Liu stated, expressing regret for actions leading to this point. He acknowledged his family's suffering since a 2015 raid on his business.
U.S. District Judge R. Gary Klausner acknowledged that family members often bear the consequences of defendants' actions. However, he emphasized that it was Liu's choices that led to this situation. Despite this, Klausner reduced Liu's sentence due to his family circumstances.
Details of the Scheme
USA Happy Baby assisted hundreds of women from China in travelling to the U.S. between 2012 and 2015 to give birth. These women paid up to $40,000 for services such as apartment rentals in Southern California. The company also collaborated with overseas entities that coached women on visa interviews and advised them on concealing pregnancies.
Federal prosecutors highlighted the seriousness of Liu's actions, stating he helped customers deceive U.S. authorities and secure citizenship for their children through fraudulent means. "For tens of thousands of dollars each, defendant helped his numerous customers deceive U.S. authorities," prosecutors noted in court documents.
Legal Proceedings and Defence
Kevin Cole, Liu's attorney, argued for a lighter sentence, highlighting Liu's role as a caretaker for his elderly parents and his otherwise commendable life history. Cole emphasized that an extensive prison term would not benefit Liu or the public. He requested a maximum sentence of 26 months with home confinement.
The case against Liu and Dong has been ongoing for several years. In 2015, federal authorities conducted raids on multiple properties in Southern California targeting businesses aiding Chinese women in giving birth in the U.S. Four years later, charges were filed against Liu, Dong, and others involved.

Businesses like USA Happy Baby have operated in California and other states for years, catering not only to Chinese nationals but also individuals from Russia, Nigeria, and other countries. While visiting the U.S. while pregnant is not illegal, providing false information on government documents is prohibited.
The primary attraction for these travellers is birthright citizenship in the U.S., which many believe could offer educational opportunities and future security for their children. Once an American child turns 21, parents can apply for permanent residency.
President-elect Donald Trump has expressed intentions to end birthright citizenship; however, such efforts would likely encounter significant legal challenges.
