Indian immigrants often find the American dream elusive due to the complexities of the US immigration system. The journey towards permanent residency and citizenship is lengthy and uncertain, impacting both personal and professional lives. The H-1B visa, a common route for skilled Indian workers, presents its own hurdles due to limited availability and a lottery-based selection process.

Many qualified applicants miss out on H-1B visas because of the annual cap. Ajeet, an immigrant, realised this system wasn't for him. "I call this the broken immigration system. India is such a large country and we are given the same seven per cent quota as any other small country. How is it fair? I figured the H1B system is a lottery system and it won’t work for me," he said. He opted to start his own business and sponsor his visa.

Challenges for Dependents

Spouses and children of H-1B holders face significant challenges. Many dependents cannot work, leading to financial strain and loss of professional identity. Meeta Damani, who arrived in the US two decades ago, experienced this firsthand. She was unable to work for years as a dependent, which led to depression. "I went through a terrible depression and then I decided to make a documentary on the issue to tell this story through that," she shared.

Dependent children also encounter difficulties in pursuing higher education or employment after turning 21. Rahael's daughter, who is nearing 18, faces potential setbacks due to delays in naturalisation. "She is aging out and if our citizenship status doesn’t change until she turns 21, she runs the risk of being sent back to India," Rahael explained.

The Green Card Backlog

The path to a green card is particularly challenging for Indian immigrants due to per-country limits. Some face wait times exceeding 50 years for employment-based green cards. Sonal Sharma, an immigration lawyer in New Jersey, often sees clients in desperate situations due to these backlogs. "There are a lot of stories I come across," she noted.

One such story involved dependents left without a home after the principal H-1B holder passed away. "It is a sad situation," Sharma remarked. The uncertainty surrounding green card applications causes many immigrants to lose opportunities.

Navigating Immigration Challenges

Priya, a marketing professional and social media influencer, discusses immigration issues with her husband online. They have gained popularity among young Indians seeking guidance on navigating US immigration challenges. "Everyone’s story is very unique when you come here," Priya said.

Despite these challenges, Priya believes that with determination, one can navigate the system. However, she questions why it should be so difficult: "The point really is why should we be putting in so much effort into it."

The combination of H-1B limitations, dependent visa restrictions, and green card backlogs creates a challenging environment for Indian immigrants. While the American dream remains attainable, the path is more difficult than many anticipate. There is hope that these systems will become less complex, allowing individuals to achieve their goals with greater certainty.
