Kansas Newspaper Staffer Files Lawsuit After Police Raid Raises Concerns
On March 30, in Kansas, Cheri Bentz, the office manager of a weekly newspaper, initiated legal action against local police over a controversial raid that took place last year. This lawsuit, filed in federal court, marks the third employee from the Marion County Record to seek justice after their newsroom was forcibly entered by police on August 11. The incident, which also involved a search of Publisher Eric Meyer's home and the confiscation of equipment and personal cellphones, has ignited widespread discussions on press freedom.

The raid was led by then-Marion Police Chief Gideon Cody, who is named as a defendant in Bentz's lawsuit. Cody justified the operation with allegations of potential identity theft or other criminal activities by the newspaper, specifically in relation to accessing a local restaurant owner's state driving record. However, Cody's actions have come under scrutiny, especially after body camera footage revealed an officer searching through a reporter's desk for information on Cody's previous employment with the Kansas City, Missouri, Police Department.
The fallout from the raid has been significant. Not only did it place Marion—a small town of approximately 1,900 residents—into a national spotlight over concerns of press freedom violations, but it also had personal repercussions for those involved. Eric Meyer linked the stress induced by the raid to the subsequent death of his 98-year-old mother, who passed away a day after the police action.
Bentz's lawsuit details her experience during the raid, highlighting how she was preparing payroll when officers arrived with a search warrant she deemed unconstitutional. The document targeted the Marion County Record and its staff for their journalistic activities. Despite explaining her administrative role and lack of involvement in investigative reporting, Bentz claims she was unlawfully detained and interrogated.
The legal challenge also touches on the broader context leading up to the raid. The newspaper had been investigating why Cody left his position with the Kansas City police—a role that paid nearly USD 116,000 annually—for the Marion job, which offered USD 60,000 a year. This investigative effort reportedly upset local authorities, including the town's then-mayor, who is also named as a defendant in Bentz's suit.
Legal experts have weighed in on the matter, suggesting that the raid likely breached state or federal laws designed to protect press freedom. As Bentz seeks redress for what she describes as significant emotional distress caused by the raid, her lawsuit underscores ongoing concerns about journalistic rights and freedoms in small-town America.
