Former Brazilian President Jair Bolsonaro is facing yet another legal challenge as he is under investigation for allegedly harassing a humpback whale while riding a personal watercraft off the coast of Sao Paulo last year. The incident, which was captured on video and circulated on social media, has sparked outrage and raised concerns about Bolsonaro's disregard for environmental laws.

Investigation and Legal Implications
Bolsonaro appeared at the federal police station in Sao Paulo on Tuesday, accompanied by his lawyer and a former adviser who was present during the alleged incident. The investigation is one of several legal battles that the former far-right leader is currently facing. Since leaving office a year ago, Bolsonaro has been banned from running for office until 2030, investigated for plotting a coup to remove his successor from power, and had his passport seized.
Video Evidence and Legal Consequences
The video that surfaced in June 2023 shows a man, believed to be Bolsonaro, riding a personal watercraft dangerously close to a whale, seemingly recording the encounter with a cellphone. According to federal prosecutors, who are also investigating the case, the man appeared to be Bolsonaro. Under Brazilian legislation, motorized vessels must maintain a minimum distance of 100 meters from whales and other cetaceans. Any intentional attempt to get closer can result in a prison sentence of two to five years and a substantial fine.
Political Persecution Claims and Ongoing Investigations
Bolsonaro's supporters view the investigation as another instance of political persecution, an argument he has frequently made since leaving office. Last week, Bolsonaro was questioned by authorities in the capital, Brasilia, regarding his alleged involvement in a plot to overthrow his successor, Luiz Inácio Lula Silva. Bolsonaro chose to remain silent during the questioning, and his passport was seized in a previous police operation.
In addition to the whale harassment case and the coup plot investigation, Bolsonaro is also facing scrutiny in other legal matters. He was recently questioned, along with his wife and close aides, about an attempt to smuggle in diamond jewelry worth approximately $3 million and the sale of luxury watches he received as gifts from Saudi Arabia during his presidency. Furthermore, the nation's intelligence agency is being investigated for allegedly spying on Bolsonaro's political opponents while he was in office.
Legal Experts' Opinions
Legal experts suggest that if the authorities can prove Bolsonaro intentionally approached the whale, he may face a fine as the most severe punishment. According to the online news site G1, a local politician found guilty of similar charges in the same area was fined 2,500 reais, equivalent to just over $500.
The investigation into Bolsonaro's alleged harassment of a humpback whale adds to the growing list of legal challenges he is confronting.
