The commencement of online filing for H-1B applications for FY25 in February has been announced by the United States. Organizational accounts facilitating online collaboration and submission of H-1B registrations will also be launched by the US Citizenship and Immigration Services (USCIS).

Organizational accounts for non-cap filings and the fiscal year (FY) 2025 H-1B cap season will be launched by the USCIS. These accounts will enable collaboration among multiple individuals within an organization and their legal representatives for the preparation of H-1B registrations, Form I-129, Petition for a Nonimmigrant Worker, and associated Form I-907, Request for Premium Processing Service.

Announcement of Availability and Registration Dates

The availability of organizational accounts and H-1B registration dates will be announced by the USCIS at the end of January. USCIS Director Ur M. Jaddou emphasized the agency's commitment to improving and streamlining processes, describing the introduction of organizational accounts as a significant step forward.

Full Electronic H-1B Lifecycle

With the launch of organizational accounts and online filing of I-129 H-1B petitions, the entire H-1B lifecycle will become fully electronic, from registration to the final decision and transmission to the Department of State, according to Director Jaddou.

Filing Options for H-1B Petitions

Once the portal is ready to accept online filings, H-1B petitions (Forms I-129) and associated premium processing requests (Form I-907) may be filed. The USCIS will facilitate online filing through three options:

1. Online filing by the petitioner through its organizational account.
2. Online filing by the petitioner's legal representative.
3. Paper-based petition filing.

National Engagements and Guidance Sessions

The USCIS plans to host two national engagements on organizational accounts on January 23 and January 24. Additionally, several smaller sessions leading up to the H-1B registration period will guide organizations and legal representatives through the process. These sessions will provide an opportunity for individuals to ask questions and seek clarification.

Biden Administration's Efforts to Optimize H-1B System

Last year, the Biden administration introduced changes aimed at enhancing the efficiency of the H-1B system while maintaining the annual cap of 60,000 visas. These adjustments focused on streamlining eligibility criteria and providing increased flexibility to F-1 students, entrepreneurs, and those employed by nonprofit organizations. The overarching goal is to reinforce the program's integrity measures by addressing misuse and fraud. The proposed rule specifically prohibits related entities from submitting multiple registrations for the same beneficiary.
