In a significant development, the Justice Department has charged a former Google software engineer, Linwei Ding, with stealing artificial intelligence (AI) technology from the company while concurrently working with two Chinese-based companies. Arrested and Charged
Ding, a Chinese national, was apprehended in Newark, California, and faces four counts of federal trade secret theft, each carrying a potential sentence of up to 10 years in prison. The announcement of the charges was made by Attorney General Merrick Garland at an American Bar Association Conference in San Francisco, emphasizing the severity of the situation.
FBI Director's Statement
FBI Director Christopher Wray expressed grave concerns regarding the theft of innovative technology and trade secrets from American companies, emphasizing the detrimental impact on jobs, the economy, and national security. He stressed the lengths that affiliates of companies based in China are willing to go to acquire American innovation.
Justice Department's Warnings
Justice Department leaders have recently raised alarms about the potential misuse of AI technologies by foreign adversaries to harm the United States. Deputy Attorney General Lisa Monaco emphasized the prioritization of AI enforcement within the administration's multi-agency Disruptive Technology Strike Force. FBI Director Wray also highlighted the ease with which adversaries can interfere in the American political process using AI and emerging technologies.
Details of the Indictment
The indictment unsealed in the Northern District of California alleges that Ding, who had access to confidential information about Google's supercomputing data centers, began uploading hundreds of files into a personal Google Cloud account in 2021. Shortly after the theft commenced, Ding was offered the position of chief technology officer at a Chinese technology company that promoted its use of AI technology.
The indictment further states that Ding traveled to China, participated in investor meetings, and sought capital for the company. Additionally, he founded and served as the chief executive of a China-based startup aiming to train large AI models powered by supercomputing chips.
Google's Response
Prosecutors assert that Ding failed to disclose his affiliations to Google and resigned from the company on December 26, 2022. Subsequently, Google officials discovered Ding's presentation as the CEO of one of the Chinese companies at an investor conference in Beijing. Surveillance footage revealed that another employee scanned Ding's access badge to make it appear as though he was present at work while he was actually in China.
Legal Representation
As of now, it remains unclear whether Ding has legal representation to speak on his behalf.
