Delta Airlines Sued in Class Action Over Refunds Following Tech Outage

Delta Air Lines is currently embroiled in a class action lawsuit, alleging the airline refused to issue refunds following a significant technology outage last month. The lawsuit, filed in the US District Court Northern District of Georgia Atlanta Division, represents Delta customers affected by the incident. They claim Delta ignored or denied their refund requests for cancelled or delayed flights.

Delta Sued Over Tech Outage Refunds

The complaint also accuses Delta of failing to provide meal, hotel, and ground transportation vouchers to all impacted passengers. It further alleges that the airline continues to refuse reimbursement requests for these unexpected expenses. "These unfair, unlawful, and unconscionable practices resulted in Delta unjustly enriching itself at the expense of its customers," the lawsuit states.

Delta's Response and Ongoing Investigations

Delta, headquartered in Atlanta, has not yet responded to requests for comment on the lawsuit. The US Department of Transportation is investigating why Delta struggled more than other airlines to recover from the outage. Transportation Secretary Pete Buttigieg mentioned that the department would also review Delta's customer service issues, including long assistance lines and reports of unaccompanied minors stranded at airports.

On Tuesday, Microsoft announced it was joining cybersecurity firm CrowdStrike in countering Delta's claims. Delta blames these companies for causing thousands of flight cancellations due to the July outage. A lawyer for Microsoft stated that Delta's key IT systems are likely serviced by other technology companies, not Microsoft Windows.

Financial Impact and Legal Threats

Delta CEO Ed Bastian previously indicated that the global technology outage began with a faulty upgrade from CrowdStrike on machines running Microsoft Windows. This incident reportedly cost the airline USD 500 million. Bastian hinted at potential legal action against those responsible.

CrowdStrike has disputed Delta's claims and noted that both it and Microsoft offered assistance to help Delta recover from the outage. According to Microsoft's lawyer, CEO Satya Nadella emailed Bastian during the crisis, but received no response from the Delta CEO.

Delta's Investment in IT Infrastructure

On Tuesday, Delta highlighted its long-standing commitment to reliable service, mentioning "billions of dollars in IT capital expenditures" since 2016 and additional billions in annual IT costs. However, Delta declined to provide further comments on the ongoing situation.

The plaintiffs in the lawsuit are seeking refunds for all Delta customers whose flights were cancelled or significantly affected by the outage. The case underscores ongoing challenges airlines face with technology reliability and customer service during disruptions.

The unfolding legal battle and investigations will likely continue to draw attention as stakeholders seek accountability and resolution for the affected passengers.
