Buffalo Supermarket Shooter Payton Gendron to Face Death Penalty
Payton Gendron, who killed 10 Black people at a Buffalo supermarket in 2022, will face the death penalty in a federal hate crimes case. Prosecutors cited the substantial planning and targeting of a vulnerable victim as reasons for seeking the death penalty.
Federal prosecutors have announced their intention to seek the death penalty against Payton Gendron, the white supremacist who killed 10 Black people at a Buffalo supermarket in 2022. Gendron is already serving a life sentence without the possibility of parole after pleading guilty to state charges of murder and hate-motivated domestic terrorism.
Seeking the Death Penalty
New York does not have capital punishment, but the Justice Department has the option of seeking the death penalty in a separate federal hate crimes case. Gendron had promised to plead guilty in that case if prosecutors agreed not to seek the death penalty. However, in a recent court filing, US Attorney for Western New York Trini Ross announced the decision to pursue the death penalty, citing factors such as Gendron's careful planning of the shooting and his targeting of vulnerable victims.
Mixed Reactions from Victims' Relatives
Relatives of the victims have expressed mixed views on whether federal prosecutors should pursue the death penalty. Some, like Mark Talley, whose mother was killed in the attack, believe that a life sentence without the possibility of parole would be a more appropriate punishment, as it would ensure that Gendron spends the rest of his life surrounded by the population he tried to kill. Others prefer that Gendron face the death penalty as a form of justice for their loved ones.
Biden Administration's Stance on the Death Penalty
The Justice Department has made federal death penalty cases a rarity since the election of President Joe Biden, who opposes capital punishment. This is the first time Attorney General Merrick Garland has authorised a new pursuit of the death penalty. Under his leadership, the Justice Department has permitted the continuation of two capital prosecutions and withdrawn from pursuing death in more than two dozen cases.
Previous Cases and Moratorium
The Justice Department has successfully sought the death penalty in a few recent cases, including the antisemitic gunman who murdered 11 people at a Pittsburgh synagogue and an Islamic extremist who killed eight people on a New York City bike path. However, the department has declined to pursue the death penalty in other mass killings, such as the case of the gunman who killed 23 people at a Walmart in El Paso, Texas.
In 2021, Garland instituted a moratorium on federal executions pending a review of procedures. While the moratorium does not prevent prosecutors from seeking death sentences, the Justice Department has done so sparingly.
Buffalo Supermarket Attack
On May 14, 2022, Gendron carried out a racially motivated attack at a Tops Friendly Market in Buffalo, New York. He drove over 200 miles from his home and chose the supermarket because it was located in a predominantly Black neighbourhood. Gendron livestreamed the massacre from a camera attached to his tactical helmet, targeting shoppers and workers with a semi-automatic rifle.
The attack resulted in the deaths of 10 people, ranging in age from 32 to 86. The victims included eight customers, the store security guard, and a church deacon who helped shoppers with their groceries. Three people were wounded but survived.
Gendron's rifle was marked with racial slurs and phrases, including "The Great Replacement," a reference to a conspiracy theory about a plot to diminish the influence of white people.
The decision by federal prosecutors to seek the death penalty against Payton Gendron has sparked discussions about capital punishment and its application in cases of hate crimes and mass shootings. As the case proceeds, the outcome will be closely watched by the families of the victims, legal experts, and the public.
