British Judges Exit Hong Kong Court, Citing Political Situation Concerns
Two esteemed British judges, Jonathan Sumption and Lawrence Collins, have officially resigned from their positions as non-permanent overseas judges on Hong Kong's Court of Final Appeal, as confirmed by the city's judiciary on Thursday. This development has intensified concerns regarding the erosion of the rule of law in Hong Kong, following the imposition of a national security law by Beijing.

While the judiciary's announcement did not delve into the specifics behind Sumption and Collins' decisions to step down, Collins revealed to The Associated Press that his resignation was motivated by "the political situation in Hong Kong." However, he also emphasized his continued "fullest confidence in the court and the total independence of its members." Sumption has indicated plans to issue a statement on the matter next week.
The presence of non-permanent overseas judges in Hong Kong's top court has been a longstanding tradition since the former British colony reverted to Chinese sovereignty in 1997, highlighting the city's unique common law jurisdiction. The recent resignations of Sumption and Collins mark a significant moment, reflecting growing apprehensions about Hong Kong's judicial independence and adherence to the rule of law amidst the sweeping changes brought about by the 2020 national security law.
This law has led to the arrest of numerous pro-democracy activists, including some of the city's most prominent figures, effectively quashing public dissent. Just last week, a Hong Kong court convicted 14 pro-democracy activists for conspiring to commit subversion in what has been described as the city's largest national security case thus far.
Despite these developments, both Beijing and the Hong Kong government have defended the national security law, asserting that it has restored stability to the city after the massive anti-government protests in 2019. They also maintain that Hong Kong's judicial independence remains intact.
However, the resignations of Sumption and Collins are not isolated incidents. Since the enactment of the national security law in June 2020, several other overseas judges have resigned from Hong Kong's Court of Final Appeal. Australian judge James Spigelman cited concerns related to the content of the national security legislation as his reason for stepping down. In 2021, British judge Baroness Brenda Hale announced her departure upon completing her first term. Furthermore, in 2022, British judges Robert Reed and Patrick Hodge also resigned, with Reed expressing an inability to serve without seeming to endorse an administration that has strayed from principles of political and expressive freedom.
The series of resignations among overseas judges from Hong Kong's highest court underscores a growing unease within the international legal community about the city's legal landscape under Chinese rule. These departures signal a critical juncture for Hong Kong's judiciary system, raising questions about its future direction and independence.
