Brazil's Government Compensates Family of Journalist Vladimir Herzog Killed During Military Dictatorship

The Brazilian government has officially acknowledged its responsibility for the death of Vladimir Herzog, a journalist who died while in custody 50 years ago. The military regime at the time falsely claimed he had committed suicide. Herzog's family welcomed this admission, which includes compensation from the government. "This apology is not merely symbolic," said Ivo Herzog, his son, from the Vladimir Herzog Institute in Sao Paulo.

Compensation and Recognition

The settlement involves a payment of nearly 3 million Brazilian reais, approximately USD 544,800, to the Herzog family for moral damages. Additionally, Herzogs widow, Clarice Herzog, will receive retroactive pension payments as per a previous court ruling. Herzog's case, along with Rubens Paiva's, has become emblematic of the struggle for justice for victims of Brazil's military dictatorship from 1964 to 1985.

Vladimir Herzog was born in Osijek, now part of Croatia, in 1937. His family fled Nazi-occupied Yugoslavia in 1941 and settled in Brazil. As a Jewish journalist and news director at São Paulo's TV Cultura, he was summoned by intelligence agents in October 1975 over alleged ties to the Communist Party. Despite denying these allegations, he was detained and never returned home.

Historical Context and Legal Proceedings

The military claimed Herzog hanged himself with a belt in his cell, releasing a staged photo of his body. In 1978, while Brazil was still under dictatorship, a court ordered an investigation into his death. In 2018, the Inter-American Court of Human Rights found Brazil guilty of crimes against humanity for Herzog's killing and mandated an official apology.

Jorge Messias, Brazil's federal legal counsellor, praised the agreement as a testament to Brazil's dedication to democracy. "Today, we are witnessing something unprecedented: The Brazilian state formally honouring the memory of Vladimir Herzog," he stated. This comes amid trials of military officers accused of attempting to keep former president Jair Bolsonaro in power despite losing the 2022 election.

Impact on Democracy

Messias highlighted the agreement's importance during a turbulent time for Brazil's democracy. He noted that during the 2022 election, Brazil faced a choice between reaffirming democracy or risking a return to past horrors experienced during the dictatorship. Ivo Herzog expressed relief that this settlement concludes his family's long fight for justice.

"This has been a struggle not only of the Herzog family but of all families of the murdered and disappeared," Ivo Herzog remarked. The settlement represents closure for many affected by the regime's atrocities. Official estimates indicate that 434 people were killed or went missing during Brazil's military rule.

The resolution marks a significant step towards acknowledging past injustices and ensuring they are not repeated. It serves as a reminder of the importance of upholding democratic values and human rights in contemporary Brazil.
