Biden Administration Delays Menthol Cigarette Ban Amidst Civil Rights Discussions
President Joe Biden's administration has once again postponed its comprehensive strategy to prohibit menthol cigarettes, marking the second delay in recent times. This move, while potentially averting discontent among Black voters before the November elections, is expected to provoke frustration among anti-smoking groups. Health and Human Service Secretary Xavier Becerra announced on Friday that the administration requires additional time to review feedback, including inputs from civil rights organizations, without specifying a timeline for the rule's implementation.

"It's clear that there are still more conversations to have, and that will take significantly more time," Becerra stated. In the lead-up to this announcement, the White House engaged with various groups opposed to the ban, including civil rights activists, law enforcement representatives, and small business owners. This development represents a further delay for the Food and Drug Administration (FDA), which has been working towards a menthol ban for over a decade across different administrations but has yet to finalize a rule.
The FDA's initiative to ban menthol cigarettes has faced obstacles from tobacco industry opposition and shifting political priorities. The potential repercussions of this decision on Black voters have been closely analyzed by both Republicans and Democrats as they prepare for November's election. Despite these challenges, anti-smoking advocates have been urging the FDA to remove menthol from the market since it gained regulatory authority over certain tobacco ingredients in 2009. Notably, menthol remained exempt from the initial ban due to negotiations by industry allies in Congress, even though the law directed the FDA to investigate the matter.
Smoking rates among U.S. adults stand at over 11%, with similar percentages between white and Black individuals. However, approximately 80% of Black smokers prefer menthol cigarettes. According to the FDA, menthol conceals the harshness of smoking, making it easier for individuals to start smoking and more challenging to stop. This preference also extends to most teenagers who smoke cigarettes.
The ongoing debate over menthol cigarettes highlights a complex intersection of public health concerns, racial dynamics, and political considerations. As the Biden administration takes additional time to deliberate on this issue, the future of menthol cigarettes remains uncertain amidst varying stakeholder interests.
