UP woman gets triple talaq and is now being forced to perform nikah halala with father-in-law

Nikah Halala is an extremely controversial Islamic practice which requires a Muslim woman to remarry, consumate the marriage in order to marry her first husband

New Delhi, Feb 08: A case of triple talaq and assault has been reported in the Farrukhabad district of Uttar Pradesh. The victim Arshi Fatima claimed that her husband Ali Ashraf Qadri had first given her triple talaq and is now applying her on her to perform Nikah halala with her father-in-law in the name of compromise. She also claimed that her threatening to kill her.

The woman had filed a complaint with the Maudarwaja police in August 2022, but no action has been taken against the accused. Dejected about no action being taken, she approached District Magistrate, Sanjay Kumar's office on February 7 2022.

As additional magistrate Narendra Kumar was leaving the DM's office, she stood in front of his vehicle. The security personnel then handed over the complaint letter to the additional magistrate. On receiving the letter, the magistrate returned to the office to hear her out. He then assured her that action would be taken.

A report said that the lady had first filed a report against the accused under crime number 373/2022, section 323 of the Muslim Women Act with the police. The police have not yet taken any legal action against the accused in the matter.

In her complaint, she said that the investigating officer in the Maudarwaja police station had dropped the names of accused Sayeedullah, Rihanna, Nida, Faizi, Shoaib, Mushir, Sarwar Hafiz, Master from the case.

She also alleged that when she opposed triple talaq, her husband beat her up and threatened her with a pistol and told me that her dead body will not be found if she dared taking legal action against her.

She further said, " he caused my father's accident and now he is pressurising me to perform halal with his father in order to accept back as his wife."

While speaking with OpIndia, she said that despite being elder and like my father, my father-in-law was eager to perform halala with her. " I did not get any support and even my my mother-in-law supported all that was happening. Everyone in the family is highly educated, but their behaviour is horrible," she also said.

What is Nikah Halala:

Nikah Halala is a controversial Islamic practice where a woman who has been divorced from her husband and wishes to remarry him has to first get married to another man. She has to consummate that marriage and then get a divorce. Several Islamic scholars too have frowned upon this process and say that this is a way of mistreating a woman. There is no consensus about this practice by many Islamic scholars.

What is triple talaq:

Triple talaq or biddat in which a man can divorce his wide by uttering the word 'talaq' thrice in succession. In 2017, the Indian government passed a law criminalising this practice and punishable with a jail term. The same was challenged but the Supreme Court outlawed the Islamic practice.
