Triple Death Sentence Issued for Brutal Rape and Murder of Five-Year-Old Girl in Bhopal

A special court sentenced a 30-year-old man to a triple death sentence for the rape and murder of a minor girl. The court described the crime as extremely cruel, stating that the accused deserved a punishment beyond the death penalty. This case was deemed one of the rarest of rare cases, highlighting the severe threat posed to societal values if not appropriately punished.

Triple Death Sentence for Bhopal Rape-Murder Case

The court also sentenced Atul Nihale's mother and sister to two years in prison for their involvement. They were convicted of helping conceal evidence related to the crime. The five-year-old victim from Shahjahanabad, Bhopal, was raped and murdered in September 2024. This marks the first instance of a triple death sentence being awarded in the state.

Details of the Crime

On September 24, 2024, the young girl went missing after leaving her uncle's flat in Shahjahanabad. Her grandmother searched for her but eventually sought police assistance when she couldn't be found. The police employed technical surveillance and a dog squad during their investigation.

During their search, officers noticed a foul smell coming from Nihale's flat. His mother and sister claimed it was due to dead rats and had cleaned with phenyl. However, police continued their search despite their protests. The smell led them to a white plastic water tank where they discovered the girl's body.

Investigation and Evidence

The body was taken to AIIMS Bhopal, where doctors confirmed she had been brutally raped and injured. During interrogation, Nihale confessed to the crime, admitting his mother and sister helped hide it. Police recovered the victim's clothes and the knife used in the attack. DNA tests confirmed Nihale's involvement.

Nihale's defence presented a 2015 doctor's prescription claiming mental illness, but a court-ordered examination found him mentally healthy. The court noted his demonic nature and brutal actions, stating he showed no remorse after committing the crime.

Court's Rationale for Sentencing

The court emphasised that without appropriate punishment, such crimes pose a significant threat to society's values and personal safety. It highlighted that there was no scope for improvement in Nihale due to his cruel and sadistic nature. The aggravated circumstances outweighed any mitigating factors.

The judge stated that this case warranted the death penalty, questioning whether releasing such an individual aligns with human rights. Nihale faced charges under various sections of Bharatiya Nyaya Sanhita (BNS) and the POCSO Act.

The court stressed that social security is fundamental to India's Constitution. It questioned how a civilised society could exist if children cannot safely play in their own environments. The verdict underscores the importance of ensuring justice for heinous crimes against minors.
