Shahrukh Pathan Granted Bail in Delhi Riots Case
In a recent development, Shahrukh Pathan, who gained significant media attention for brandishing a pistol at a policeman during the northeast Delhi riots in 2020, was granted bail on October 7. However, it is important to note that this does not mean he will be released from jail as he stands accused in another rioting case.
Pathan's Involvement and Arrest
Shahrukh Pathan was part of an unruly mob that allegedly caused gunshot injuries to one individual near Maujpaur Chowk on February 24, 2020. This incident led to his arrest and subsequent detainment since April 3, 2020. The order regarding his bail plea was pronounced by Additional Sessions Judge Amitabh Rawat.

The Court's Decision
Judge Rawat made his decision based on the overall facts and circumstances surrounding the case. He noted that public witness Rohit Shukla had been examined and all remaining witnesses were police officials. Furthermore, all other co-accused individuals involved in the same case have already been granted bail. Therefore, considering these factors along with Pathan’s prolonged detention period without trial completion; Judge Rawat approved Shahrukh Pathan's bail application.
Bail Conditions
The court has laid down specific conditions for granting him bail which involves furnishing a personal bond of Rs 50,000 along with two sureties of similar amount. It is crucial to mention here that while approving the bail plea of Shahrukh Pathan; Judge Rawat clarified that although he was part of the violent mob causing chaos during those riots; there is no evidence suggesting that he shot victim Rohit Shukla.

This decision comes after months-long legal proceedings, with the case still at the stage of prosecution evidence. The fact that Pathan has been in custody for over a year without trial completion raises questions about judicial delays and their implications on the accused.
