Allahabad HC Petitioned Against Closure of Meat Shops for Kanwar Yatra

A petition has been submitted to the Allahabad High Court challenging the Varanasi Municipal Corporation's (VMC) decision to close meat shops along the Kanwar Yatra route during Sawan. The National Loktantrik Party, represented by its national president executive Mohammad Suhail, filed the petition.

HC Petition Against Meat Shop Closure

According to Suhail, the VMC's directive infringes on the fundamental freedom to carry out any occupation, trade, or business as guaranteed under Article 19(1)(g) of the Indian Constitution. Additionally, it violates the fundamental right to life with dignity and personal liberty under Article 21.

Impact on Livelihoods

The petitioner argues that the closure of meat shops will adversely affect the livelihoods of shopkeepers. These businesses are a primary source of income for many owners, and shutting them down due to their sale of non-vegetarian items is deemed unreasonable. Suhail stated in the plea that this decision breaches their fundamental right to conduct their trade or business.

The plea highlights that many of these shops are rented, and sudden closures will significantly impact them. Most of these meat shops are owned by individuals of Muslim faith, adding another layer of concern regarding identity-based exclusion.

Historical Context and Rights

The petition notes that the Kanwar Yatra in Sawan is a long-standing tradition during which meat shops have historically remained open. The authorities' new directive is seen as an attempt to create an exclusion based on identity. The petitioner also emphasizes that this decision restricts individual liberty and choice of food, affecting those who consume meat for dietary or medical reasons.

On Sunday, ahead of Sawan's commencement, VMC announced the closure of meat shops along the Kanwar Yatra route. Officials stated that this decision was made to ensure that Kanwariyas do not encounter any issues during their pilgrimage.

Number of Affected Shops

VMC officials disclosed that there are 96 meat shops situated along the Kanwar Yatra route. The directive aims to prevent any inconvenience for Kanwariyas during their yatra.

The petition underscores that such decisions promote a breach of fundamental rights related to individual liberty and food choices. It also stresses that these actions could have severe economic repercussions for shop owners who rely on their businesses for livelihood.

The court's decision on this matter will be closely watched as it touches upon constitutional rights and religious practices, impacting both shopkeepers and pilgrims.
