On Delhi LG’s Power, Centre Moves SC Seeking Review of May 11 Verdict

The Centre has moved the Supreme Court seeking a review of its May 11 judgement wherein it was held that the Delhi government has legislative and executive powers in the national capital.

The review comes in the wake of the Centre bringing out an ordinance on Friday to create a National Capital Civil Service Authority that will have the power to recommend the transfer and posting of all Group A officers and officers serving in Delhi.

On Friday, the ordinance was brought in by the Centre as an amendment to the Government of National Capital Territory of Delhi Act, 1991. The ordinance called for the formation of the National Capital Territory of Delhi Act, 1991.

According to the ordinance the authority will be headed by the Delhi Chief Minister and will also include the chief secretary and principal Home Secretary. All matter which require to be decided will be one through a majority of votes and the authority can also make recommendations regarding the transfers and tenures of bureaucrats to the Lieutenant Governor.

The LG can either approve or pass orders to give effect to the recommendations. The LG can also return the files to the authority and in case of a difference of opinion, the LG would have the final say, the ordinance also reads.
