New Legislation Passed in Odisha Assembly Paves Way for Strategic Development Projects

Four bills were passed by the Odisha assembly, with a notable one being the land acquisition and resettlement bill. This legislation allows for exemptions of strategic and development projects from social impact assessments. The move has sparked controversy as opposition members walked out during its passing.

The Odisha legislative assembly, on Wednesday, passed four significant bills including a controversial land acquisition and resettlement bill. This new legislation will allow the government to exempt strategic and development projects from social impact assessments. The passage of these bills occurred amidst a walkout by opposition members from the Bharatiya Janata Party (BJP) and Congress over unrelated issues.

Controversy Surrounding Land Acquisition Bill

Land Acquisition and Resettlement Bill

The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Odisha Amendment Bill, 2023 was initially introduced in the assembly in March but was later withdrawn following severe criticism. This bill has sparked controversy as it enables the government to bypass social impact assessments for 'strategic and development projects', along with special provisions for safeguarding food security.

This amendment affects The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement RFCTLAR&R Act, 2013 - a central legislation that came into effect on January 1, 2014. Provisions under this act such as mandatory social impact assessment studies (SIA), special provision for food security, and lapsing of SIA study reports have been identified by officials as causing delays in land acquisition processes.

Government's Stance on New Legislation

In response to these concerns, state Revenue and Disaster Management Minister Sudam Marndi issued a statement explaining the rationale behind this move. He stated that certain provisions of the RCTLAR&R Act were found to be delaying land acquisitions necessary for various strategic initiatives.

The state government is keenly pushing its Make-in-Odisha initiative which aims at attracting investment into the region through industrial growth. However, stringent regulations surrounding land acquisition have been perceived as hindrances towards achieving this goal. The new amendment seeks to streamline this process thereby expediting industrial development in the region.

Implications of the New Legislation

While this new legislation is expected to accelerate economic growth in Odisha, it has also raised concerns about potential social and environmental impacts. The exemption of strategic and development projects from social impact assessments could potentially undermine the rights of local communities, particularly those dependent on land for their livelihoods.

Moreover, bypassing such assessments might lead to unforeseen consequences on food security as agricultural lands could be indiscriminately acquired for industrial purposes. These issues have led to widespread criticism and opposition against the bill.

In conclusion, while the newly passed bills including the controversial land acquisition one are poised to expedite economic growth in Odisha through increased investments, they also pose significant challenges. Balancing rapid industrialization with sustainable development and safeguarding community rights will be a crucial task for the state government moving forward. It remains to be seen how effectively these concerns will be addressed amidst ambitious plans for economic advancement.
