Noida Court: Seema Haider To Face Legal Action By Her Husband In Marital Dispute

In Noida, a city court was approached this week by Seema Haider's Pakistani husband Ghulam Haider, represented by Indian lawyer Momin Malik, accusing Seema and her partner Sachin Meena of cheating and seeking legal proceedings against them.

The application was filed by Malik under CrPC's Section 156 (3), allowing a magistrate to order an investigation, as reported by Times Of India.

Seema Haider To Face Legal Action - Here's why?

Seema, a resident of Karachi, illegally entered India last year with her four children to live with Sachin, a grocery store worker in Rabupura. The claim of meeting and falling in love while playing PUBG was made by the two. They also claimed to have gotten married in Kathmandu during a previous meeting.

Momin alleged that Seema had not obtained a divorce from Ghulam Haider and that her marriage with Sachin was not valid. Before additional chief judicial magistrate Pradeep Kumar Kushwaha on Thursday, Momin contended that Seema had mentioned Ghulam Haider as her husband in her bail application after she was arrested for illegally entering India, despite publicly claiming to have married Sachin, as reported by Times Of India.

A notice was claimed to have been issued by the court to Noida police, with a request for submission of a report by April 18, as stated. Seema and Sachin were arrested by Noida police from Haryana's Ballabhgarh on July 3 last year under Section 14 of the Foreigners Act and IPC Section 120B (criminal conspiracy).

Bail was granted to them on July 7. Sachin's father, too, was arrested along with them and granted bail later. It was argued by Momin that Seema, according to the terms and conditions of the bail order, should not be involved in any criminal activity. "However, she has been frequently making controversial statements, creating a communal divide, reported by TOI.

Besides, her second marriage is not valid as she has not taken divorce from Ghulam Haider. When Seema was arrested, she identified herself as Ghulam Haider's wife. She is now claiming she married Sachin on March 13, 2023, in Nepal. If she had married Sachin, why did she use Ghulam Haider's name in the bail plea?" he argued.

It was reiterated by Momin that she cheated her husband, lied to the court in the bail application, and has been illegally living in India. "Hence, an FIR should be registered against her and her associates on charges of cheating and criminal conspiracy." AP Singh, counsel for Seema and Sachin, said Momin's application in court was a publicity stunt.

"The CrPc does not permit a Pakistani citizen to file a case in India. Seema has adopted Hinduism and married Sachin. In Pakistan, there is a tradition of oral talaq (triple talaq), and she was divorced from her husband," he said. Asked why she mentioned Ghulam Haider as her husband in the bail plea, Singh said Seema and Sachin were in police custody at the time, as per media reports.

"The accused are not solely responsible for the paperwork. Police or clerks may have written something without checking facts," he claimed. Kislay Panday, a Supreme Court lawyer, said Seema and Sachin are adults and are living together on their own will.

"The CrPc does not allow a foreign citizen to file a case in India in normal circumstances. For a trial, the complainant needs to either appear in court in person or appoint an authorised representative other than his lawyer. It is a very complex process. Ghulam Haider's case may not stand ground," he said.
