No Bulldozer Action Till October 1: Supreme Court

The Supreme Court has temporarily halted the demolition of unauthorised structures by private companies until October 1. This decision was made despite government concerns about the impact on demolitions that had followed due process. The court's ruling does not apply to illegal constructions on public roads, footpaths, or similar areas.

Justice BR Gavai and Justice KV Viswanathan stated, "The heavens won't fall if we ask you to hold your hands till the next hearing." They emphasised that no demolitions should occur without the court's permission until further notice. However, this order excludes unauthorised constructions on public streets and spaces.

Supreme Court's Stance on "Bulldozer Justice"

The court's decision emerged during hearings on petitions challenging "bulldozer justice," a term used for demolition drives targeting homes of crime suspects. The Supreme Court has criticised such actions by state governments twice this month, warning against their glorification.

The court cautioned that the Election Commission might be involved if necessary. This is significant as elections are upcoming in Jammu and Kashmir and Haryana, where the BJP aims to maintain power. Additionally, Maharashtra and Jharkhand will also have polls later this year.

Implications for Upcoming Elections

The reference to the Election Commission is crucial given the political context. The BJP is seeking to retain control in several states with elections approaching. The court's intervention could influence these political dynamics significantly.

This pause in demolitions reflects the court's concern over potential misuse of power and its impact on citizens' rights. By halting these actions temporarily, the court aims to ensure fairness and adherence to legal procedures.

The Supreme Court's directive highlights its commitment to safeguarding democratic principles and preventing arbitrary actions by authorities. This move underscores the importance of judicial oversight in maintaining checks and balances within governance.
