Uttar Pradesh DGP Introduces New Guidelines For Police Encounters To Enhance Accountability And Transparency

Amidst political uproar over alleged biased targeting of criminals, Uttar Pradesh DGP Prashant Kumar has introduced new guidelines for police encounters. These guidelines mandate the videography of crime scenes where suspects are killed or injured. This move aims to enhance transparency and accountability in police operations, according to officials.

The directives were issued after questions arose regarding a recent encounter involving Mangesh Yadav from Jaunpur. Yadav was wanted for a robbery at a jewellery store in Sultanpur on September 5, 2024. The new rules require police involved in encounters to undergo weapons testing and ballistic examinations. Additionally, handwash samples of deceased suspects must be collected.

Enhanced Investigation Protocols

The DGP's circular, dated October 11, 2024, outlines that forensic experts will examine crime scenes. Investigations will not be conducted by local police but by another station or the Crime Branch. Senior officers will also be part of the investigation team. Photographic evidence must be preserved, and families of the deceased informed immediately.

Videography is required for all encounter cases, including post-mortem examinations with at least two doctors present when an accused is killed. These measures aim to ensure thorough documentation and accountability in handling such sensitive cases.

Human Rights Case Management

The DGP stressed the importance of resolving pending cases with the National Human Rights Commission (NHRC) and State Human Rights Commission (SHRC) promptly. An ASP will act as a nodal officer to ensure timely submission of relevant records and disposal of these cases.

Senior officers like SSPs and police commissioners are tasked with monitoring nodal officers' progress monthly. The DGP warned against any negligence in these matters, emphasizing that prompt action is crucial to avoid uncomfortable situations.

Supreme Court Directives

The DGP also referenced Supreme Court directives related to a petition by People's Union For Civil Liberties (PUCL). These directives aim to establish standards and norms for police encounters, ensuring adherence to legal protocols.

Since April 2017, 210 criminals have reportedly been killed in encounters across UP. Of these, 51 were shot by STF while 159 died in district police operations. Approximately 7,500 criminals sustained injuries during separate encounters statewide.

Operation Langda Controversy

A significant number of injured criminals were shot in the leg under 'Operation Langda'. Opposition parties have accused authorities of selectively targeting individuals based on caste and religion during these encounters.

The new guidelines reflect efforts to address concerns about selective targeting while reinforcing accountability and transparency within the police force. By implementing these measures, authorities hope to build public trust and ensure justice is served fairly.
