Madhya Pradesh High Court Overturns Externment Order Against Farmer, Urges District Magistrates to Resist Political Pressure
The Madhya Pradesh High Court has ruled in favour of a farmer who challenged his banishment from Burhanpur. The court instructed the chief secretary to convene a meeting with district magistrates, urging them to resist political influence when making decisions. Additionally, the court imposed a penalty of Rs 50,000 on the respondents, including the state government and various officials.

The court's decision highlighted that the state could recover the penalty from the Burhanpur district magistrate. Justice Vivek Agrawal, part of the division bench, noted that district magistrates should not issue orders under political pressure without understanding the true intent of the MP Rajya Suraksha Adhiniyam Act of 1990. This directive was part of Monday's order.
Legal Missteps and Observations
The High Court criticised the district magistrate for failing to record witness statements. The magistrate misled the court by claiming no witnesses came forward. The court pointed out that forest offences are not included in Section 6 of the 1990 Adhiniyam. Furthermore, it noted that mere FIR registrations do not equate to convictions.
The petitioner, Anantram Awase, faced externment from Burhanpur and nearby districts for a year starting January 23, 2024. The order was issued by the collector and district magistrate. However, the High Court found this action illegal as it was based solely on FIRs without any convictions.
Implications for District Magistrates
The High Court observed that the district magistrate exceeded his authority and acted on factors outside legal considerations. The court emphasised that such actions should align with legal provisions rather than external influences. This ruling serves as a reminder for officials to adhere strictly to legal frameworks.
Justice Agrawal stated that invoking provisions of the M.P. Rajya Suraksha Adhiniyam, 1990, based only on FIRs is unjustified. The externment order was thus annulled. The court's decision underscores the importance of basing legal actions on solid evidence and convictions rather than preliminary accusations.
This case highlights the judiciary's role in ensuring that administrative actions comply with legal standards. It also stresses the need for officials to act independently of political pressures while making decisions affecting individuals' rights and freedoms.
