Justice Ganguly case: Cabinet to send Presidential reference to SC
Section 23 (1A) deals with the subject of removal from office of chairperson and members of state human rights commissions, says that such removal can be ordered by the President "on the ground of proved misbehaviour or incapacity" after the Supreme Court, on a reference being made to it by the President, holds that the chairperson/member should be removed.
Earlier in the day, Justice Ganguly said that he has not yet 'decided' on whether to resign as the chairman of West Bengal Human Rights Commission.
Asked about his next course of action in view of the possibility of the Union cabinet taking up the issue today, Ganguly said, "I will not comment on anything now."
Demands for his resignation from the WBHRC have echoed in several quarters following a three-judge Supreme Court committee's indictment of him over allegations of sexual harassment of a female law intern in December, 2012.
