Delhi Court Highlights Role of Freedom of Speech in Political Discourse and Defamation Cases
A Delhi court emphasised that freedom thrives only when speech and expression are protected by the Indian Constitution. This observation was made by Special Judge Vishal Gogne while dismissing a defamation case filed by BJP spokesperson Praveen Shankar Kapoor against Chief Minister Atishi. The judge highlighted the importance of political discourse, especially during elections, as part of free speech.

Judge Gogne noted that political debates often involve leaders accusing each other of corruption. He stated that these allegations are integral to political speech. The judge remarked that viewing Atishi's claims about MLA poaching as defamation would unfairly target the Aam Aadmi Party. He stressed that such political questions should be resolved through elections, not legal battles over defamation.
Freedom of Speech and Political Allegations
The judge asserted that Atishi's allegations about MLA poaching fall under the right to free political speech. He argued that these claims also aim to highlight alleged corrupt practices. According to him, there is no reason to treat these allegations as defamatory simply because they target the ruling party. The court reiterated that freedom of speech is enshrined in the Indian Constitution.
Judge Gogne explained that freedom of speech allows for diverse interpretations and expressions. It enables one person's perspective to differ from another's, whether it concerns welfare policies or historical figures. He mentioned that contemporary discourse sometimes questions even freedom fighters' roles, illustrating the broad scope of free speech.
Political Narratives and Constitutional Rights
The court observed that political parties often present their visions on various policies to voters. These narratives sometimes accuse opponents of violating constitutional norms or laws. Such views are protected by the Fundamental Right to Freedom of Speech and Expression. The judge questioned why criticisms or allegations of political corruption should be excluded from this protection.
This right supports the existence of varied political opinions and allows opposition parties to demand accountability in public matters. Judge Gogne emphasised that government accountability is a key expectation from voters, warranting broader tolerance for criticism against the ruling party.
Implications for Defamation Cases
The judge warned against summoning Atishi for defamation, as it would suppress free speech and public office accountability. He noted that accepting the complainant's interpretation could lead to many political leaders facing defamation charges. The judge cautioned that actions taken lightly could have far-reaching consequences.
Judge Gogne concluded that Atishi's statements align with typical political debates on accountability and corruption. He highlighted the subtle yet significant impact of lowering the threshold for perceiving defamation on freedom of speech.
