Delhi Court Orders Framing of Charges in Celebratory Firing Case

A Delhi court orders the framing of charges against Raju Singh and others for celebratory firing during a New Years Eve party, resulting in a woman's death.

The city court of Delhi has passed an order to frame charges against former Bihar MLA Raju Singh, his wife, and two others in a case related to celebratory gunfire during a New Year's Eve party at a farmhouse. The incident led to the unfortunate death of a woman.

Judge Vikas Dhull stated that the actions of accused Raju Singh, who fired from his licensed pistol during the party, indicate he was aware that firing in such crowded conditions could potentially lead to someone's death. As per this reasoning, Judge Dhull declared that Raju Singh is prima facie liable for charges under section 304 Part II of the IPC (Indian Penal Code) and under section 30 of the Arms Act.

Charges for Destruction Of Evidence

Apart from this, Judge Dhull also ordered framing of charges relating to destruction of evidence against Renu Singh (Raju Singh’s wife), along with Ramendra Singh and Rana Rajesh Singh - associates of Mr. Singh. He pointed out there were sufficient materials on record which are prima facie indicating towards their involvement in destroying evidence. Charges have been framed against Ramendra and Rana under sections 201 (destruction of evidence) and 34(common intention)of IPC while Renu has been charged solely under section 201.

Defence Arguments And Further Developments

Nitesh Rana, the advocate representing Mr.Singh argued against these charges stating lack of substantial proof from prosecution's side. The infamous incident took place at Mr.Singh’s farmhouse on December 31st ,2018 leading him and other accused individuals being booked under relevant sections by police.

In light with victim succumbing to bullet injuries later on ,section 302(murder) of IPC was added to the FIR which carries a maximum penalty of death sentence. However, this section was later discharged by court after accepting Mr.Rana’s argument that the offence did not fit within its ambit.
