Kolhapur Court Rejects Anticipatory Bail for Ex-Journalist Koratkar Over Offensive Remarks Against Shivaji Maharaj
A court in Kolhapur, Maharashtra, has denied the anticipatory bail request of Prashant Koratkar, a former journalist. Koratkar is accused of making offensive remarks about Chhatrapati Shivaji Maharaj and his son, Chhatrapati Sambhaji. Additional Sessions Judge D V Kashyap dismissed the plea, which was filed by Koratkar to avoid arrest.

Koratkar is alleged to have threatened historian Indrajeet Sawant from Kolhapur and made derogatory comments about the Maratha king and his warrior son. The Kolhapur police registered a case against him under the Bharatiya Nyaya Sanhita (BNS) for inciting hatred or enmity between groups. In response to these charges, Koratkar sought anticipatory bail from the sessions court.

The court had initially granted Koratkar interim protection from arrest on March 1. However, the Kolhapur police approached the Bombay High Court to revoke this protection and request his remand into police custody. The high court directed the Kolhapur sessions court to make a decision on the anticipatory bail plea.
During the court proceedings, public prosecutor Vivek Shukla argued that freedom of speech does not allow for arbitrary use. He cited a Supreme Court case law to support the necessity of custodial interrogation, even if the punishment for the offence is less than seven years. "A person having freedom of speech does not mean that he will not use it arbitrarily," Shukla stated.
