Allahabad HC Slaps Rs 15 Lakh Fine on AU Professor for Filing Frivolous SC/ST Act Cases

The Allahabad High Court has imposed a fine of Rs 15 lakh on an Allahabad University teacher for filing frivolous cases under the SC/ST Act against her three senior colleagues. The court also quashed the FIRs filed by her.
Abuse of Law
The court observed that the complainant, an assistant professor in the economics department, knows the law very well and had been abusing its provisions for personal gain. Justice Prashant Kumar allowed the petitions filed by professors Manmohan Krishna, Prahlad Kumar, and Javed Akhtar against her complaints.
Personal Vengeance
The court noted that the complainant filed false and frivolous cases against her colleagues to wreak personal vengeance against the Head of Department. Whenever her seniors asked her to teach properly and take classes regularly, she would file a complaint against them.
Cost Imposed
Imposing a cost of Rs 5 lakh in each case, the court said that the reputation and public image of the professors had been tarnished due to the frivolous cases. They had to face unnecessary legal proceedings to defend themselves.
FIR Lodged
On August 4, 2016, the economics department assistant professor lodged an FIR at a police station alleging that the three professors had insulted and harassed her and used words related to her caste while scolding her.
Charge Sheet and Summons
The police submitted a charge sheet in the case, and the court issued summons against the professors. The professors challenged the summons before the high court, which ultimately quashed the FIRs and imposed a fine on the complainant.
The Allahabad High Court's decision highlights the importance of responsible use of legal provisions and the consequences of abusing the law for personal gain. It serves as a reminder that frivolous litigation can have serious repercussions and can tarnish the reputation of individuals.
