High Court Chief Justice Explains Withdrawal of Kashi Vishwanath-Gyanvapi Dispute Cases
Chief Justice Pritinker Diwaker of Allahabad High Court has clarified the reasons behind withdrawing cases related to the Kashi Vishwanath-Gyanvapi land title dispute from a single-judge bench. The decision was made in the interest of judicial propriety, discipline, and transparency.
The Chief Justice of Allahabad High Court, Pritinker Diwaker, recently issued an order elucidating the reasons for the transfer of cases related to the Kashi Vishwanath-Gyanvapi land title dispute. These cases had been under review by a single-judge bench since 2021 and have now been withdrawn from it. The decision to move these contentious cases from Justice Prakash Padia's court to his own was made on administrative grounds with an aim to uphold judicial propriety, discipline, and transparency in case listing.
Concerns Over Jurisdiction

In justifying this significant decision, Chief Justice Diwaker pointed out that despite the single judge having no jurisdiction over these matters as per roster rules, he continued hearing them for more than two years. This discrepancy raised concerns about procedural correctness and necessitated intervention at a higher level.
An Impelled Response
The Chief Justice's order dated August 28 revealed another factor that prompted this shift - a complaint lodged on July 27 by one of the parties involved in the dispute. The complainant highlighted that Justice Padia had already presided over at least 75 hearings before scheduling the pronouncement of judgment on August 28. This revelation brought into question not only issues related to jurisdiction but also possible biases or irregularities in handling such sensitive cases.
Ensuring Judicial Propriety
Drawing attention towards maintaining judicial decorum and integrity, this development underscores how critical it is for courts to adhere strictly to their assigned jurisdictions. It also serves as a reminder that any deviation from established procedures can lead to questions about fairness and impartiality in legal proceedings – something that could potentially undermine public trust in judiciary system.
A Move Towards Transparency
This administrative decision made by Chief Justice Diwaker is also a step towards ensuring greater transparency in the listing of cases. By bringing this issue to light, it encourages further scrutiny into how cases are assigned and handled by different benches within the court system. It promotes accountability among judicial officers, thereby strengthening the integrity of legal processes.
In conclusion, the recent order from Allahabad High Court's Chief Justice Pritinker Diwaker serves as a significant example of administrative intervention to uphold judicial propriety and discipline. The withdrawal of Kashi Vishwanath-Gyanvapi land title dispute cases from a single-judge bench that had been hearing them despite having no jurisdiction in the matter emphasizes the importance of adhering to procedural correctness in legal proceedings. Furthermore, this decision underlines the need for transparency in case listings and fosters increased accountability within judiciary system – key factors in maintaining public trust and confidence in India's legal framework.
