Allahabad HC Halts Suspension of Commandant Dubey Amidst Conduct Allegations
The Allahabad High Court has paused the suspension of Homeguard Commandant Manish Dubey, who faced accusations of immoral conduct. The court noted that the allegations against him were vague and did not demonstrate that his private life interfered with his professional duties.

Alok Maurya, a sanitation worker, had accused his wife, SDM Jyoti Maurya, and Dubey of having an illicit relationship. He claimed that after their marriage in 2010, he supported Jyoti's studies. However, after she passed the PCS examination and became an SDM in 2015, her behaviour towards him changed, and she asked for a divorce.
Suspension and Legal Proceedings
Dubey was suspended on November 7, 2023, by the Additional Chief Secretary Home Guards in Lucknow amid the controversy. Following this, Dubey approached the high court for relief. Justice JJ Munir took up Dubey's plea and directed the state government counsel to file a reply within three weeks. The next hearing is scheduled for August 27, 2024.
The court ordered that Dubey be allowed to resume his duties and receive his salary regularly during this period. "Most of the charges on which the petitioner has been suspended include some kind of immoral behaviour by the petitioner in communicating on WhatsApp with a married woman, chatting with her and like allegations," the court stated.
Charges and Court Observations
The court observed that the summary charges against Dubey did not show that his private actions directly interfered with his official responsibilities. The order passed on July 26 mentioned that most imputations were indeterminate or vague. Only one charge indicated that Dubey left headquarters to visit a hotel in Delhi without permission.
Dubey is stationed at Ghaziabad. The court noted that travelling from Ghaziabad to Delhi without permission for a short duration might not justify imposing a major penalty. The court's decision highlighted that such actions did not significantly impact his professional duties.
Divorce Petition
SDM Jyoti Maurya has filed for divorce at the Family Court in Prayagraj. This legal step adds another layer to the ongoing controversy surrounding her relationship with Dubey and her changing attitude towards Alok Maurya after becoming an SDM.
The high court's stay on Dubey's suspension allows him to continue his duties while awaiting further legal proceedings. This decision underscores the need for clear evidence when allegations affect one's professional standing.
