Allahabad High Court Rejects Ajai Rai's Plea in 2010 Gangsters Act Case
The Allahabad High Court recently made a significant ruling regarding a petition filed by Ajai Rai, a Congress candidate for the Varanasi Lok Sabha seat. The petition sought to challenge the ongoing criminal proceedings against him and four others under a Gangsters Act case that dates back to 2010. Justice Sanjay Kumar Singh, presiding over the case, dismissed the plea, emphasizing that the trial was nearing completion and highlighting the independent nature of the offence under the Gangsters Act.

The case against Rai and his associates was initiated with an FIR lodged on March 26, 2010, by Bhanu Pratap Singh at the Chetganj police station in Varanasi. The legal battle has seen various developments, with the most recent plea involving a request to quash the trial court proceedings based on a compromise reached between the petitioners and the complainant on September 28, 2023. However, this compromise was not deemed sufficient grounds for halting the trial, especially given the specific nature of offences under the UP Gangster and Anti Social Activities Prevention Act.
The court's decision was influenced by arguments presented by the state government's counsel, who highlighted that the offences in question are non-compoundable, meaning they cannot be settled outside of court. This stance was reinforced by pointing out Rai's extensive criminal record, which includes 27 cases, underscoring the gravity of his legal entanglements.
This ruling underscores the judiciary's commitment to ensuring that trials, especially those involving serious charges such as those under the Gangsters Act, are seen through to their conclusion.
