Karisma Kapoor’s Children Get Major Court Relief As Delhi HC Freezes Sunjay Kapur’s Assets Abroad

In a major interim relief in the legal battle over late industrialist Sunjay Kapur's estate, the Delhi High Court on Thursday ordered the freezing of foreign bank accounts linked to him and directed that his assets be preserved until the dispute is fully decided. The order comes amid a bitter inheritance clash involving his third wife Priya Sachdeva Kapur and his children Kiaan and Samaira from his marriage to actress Karisma Kapoor.

Court Orders Status Quo On Estate Amid Ongoing Will Dispute

The Delhi High Court granted an interim injunction and restrained any dealing with Sunjay Kapur's estate, which has been estimated at around Rs 30,000 crore. The court also put a stop to the operation of cryptocurrency holdings and directed that no third-party rights be created over the assets during the pendency of the case.

Justice Jyoti Singh observed that the estate must remain protected while the matter is being tried, noting that the proceedings could take time.

"The question whether the estate should be preserved-the answer is in the affirmative," the court said.

The High Court made it clear that the estate should not be dissipated and directed all parties to submit detailed account statements before the court.

Karisma Kapoor's Children Allege Forged Will, Hidden Assets

Kiaan and Samaira, Sunjay Kapur's children with Karisma Kapoor, have challenged the will presented by Priya Kapur, alleging that it is forged. They have also accused her of submitting an incomplete disclosure of the late businessman's assets.

According to the children, the asset list filed before the court leaves out several high-value possessions, including expensive polo horses and luxury watches from premium brands such as Audemars Piguet and Rolex.

The timing of the will and what it contains have also raised suspicion among the legal heirs, particularly because it is being questioned by multiple members of the family.

The court, while granting interim protection, noted that Karisma Kapoor's children had made out a prima facie case. It said that if no protective order was passed now and the will was later found to be fake, it would amount to an "injustice" to them.

Lawyer Says Priya Kapur Barred From Dealing With Properties, Shares, Bank Accounts And Crypto

Appearing for Karisma Kapoor's children, Advocate Ravi Sharma said the court had specifically barred Priya Kapur from dealing with Sunjay Kapur's assets in any form.

"...The court today has granted an injunction in favour of Karisma's children, whereby it has injuncted Priya Kapur from dealing in any manner with the immobile assets of Sunjay Kapur. The Court has specifically said that Priya Kapur can not deal with any of the immobile properties, companies, shares, bank accounts and crypto wallets of Sunjay Kapur...Priya has the obligation to dispel the suspicious circumstances which were cited and which seem reasonable as pleaded by Karisma's children".

The court also restrained Priya Kapur from operating Sunjay Kapur's bank accounts, citing what it described as "suspicious circumstances" surrounding the will.

In addition, the court barred the transfer of personal belongings, artworks and provident fund payouts. It noted that Priya Kapur had already consented to some of these restrictions earlier.

Sunjay Kapur's Mother Also Questions Authenticity Of Will

The dispute has deepened further with Sunjay Kapur's mother, Rani Kapur, also casting doubt on the validity of the will. She has said she was never informed that such a will existed and pointed out that it does not even acknowledge her.

Through Senior Advocate Vaibhav Gaggar, Rani Kapur argued that it was unlikely her son would leave his entire estate solely to Priya Kapur, especially given his close relationship with his children and wider family.

She also alleged that after Sunjay Kapur's death in London in June last year, Priya Kapur moved quickly to assume control over businesses and assets. According to her, the disclosures made before the court were incomplete and failed to mention several valuable items such as artworks, watches, bank accounts, insurance policies and rental income.

Rani Kapur further questioned the declared estate value of around Rs 1.7 crore, saying it appeared inconsistent with the industrialist's known earnings and asset profile.

Onus Now On Priya Kapur To Remove Court's Doubts

The High Court has now placed the burden on Priya Kapur to clear the doubts surrounding the authenticity of the will. The court said the suspicious circumstances flagged by the petitioners appeared reasonable enough to require scrutiny at trial.

For now, the order ensures that Sunjay Kapur's estate remains locked in place until the court examines the competing claims in detail, giving temporary protection to Karisma Kapoor's children in what is shaping up to be a closely watched inheritance dispute.
