WATCH | Karnataka HC Judge Rebukes Woman Seeking Rs 6 Lakh/Month Maintenance: 'Let Her Earn'

In a recent court proceeding that has gone viral on social media, an advocate argued on behalf of a woman seeking Rs 6 lakh in monthly maintenance from her husband.

The advocate cited various expenses, including Rs 15,000 for shoes, dresses, and bangles, Rs 60,000 for food, and Rs 4-5 lakh for medical expenses related to knee pain and physiotherapy.

During the hearing on August 20, the judge expressed concerns, stating, "This is an exploitation of the process of the court."

The judge added, "Please don't tell the court that this is all a person requires. Rs 6,16,300 per month. Does anybody spend this much? A single lady for herself. If she wants to spend, let her earn. Not on the husband. You don't have any other responsibility of the family. You don't have to take care of the children. You want it for yourself... You should be reasonable."

The judge further advised the advocate to propose a reasonable amount, warning that the plea might otherwise be dismissed.

The case involves Radha Munukuntla, who had previously been granted Rs 50,000 per month as maintenance by the Additional Principal Judge, Family Court, Bengaluru, on September 30, 2023.

Unsatisfied, she moved to the High Court seeking an increase in the interim maintenance amount.

What does Supreme Court say on alimony?

Regarding alimony, the Supreme Court of India has clarified that maintenance or permanent alimony should not be punitive but should ensure a decent standard of living for the wife.

The Court has set a benchmark of 25% of a husband's net monthly salary as the alimony amount, while one-time settlements generally range from 1/5th to 1/3rd of the husband's net worth.
