BMW hit-and-run: Forensic proof will nail accused, say cops

Ahmedabad, Feb 28: Police are hopeful that despite the delay in arresting the car driver who fatally knocked down two college students from their motorcycle here on the night of Feb 24, they can build a watertight case against the accused on the basis of forensic evidence.

Vismay Shah was taken into custody only on the morning of Feb 27. This means investigators will find it difficult to determine through tests whether he was under the influence of alcohol at the time of the accident.

Reports say that the 27-year-old was driving his BMW at breakneck speed. Even after hitting the motorycle in the Judges Bungalow area, Shah did not slow down. In fact, his car dragged the motorcycle for nearly 35 metres before it crashed into a roadside tree and stopped.

Shah then emerged from the BMW, offered a token apology for the accident and left in another car.

An engineering student Shivam Dave who was riding pillion on the ill-fated motorcycle succumbed to his injuries on the spot. His friend Rahul Patel died in a private hospital on Feb 27 barely hours after Shah was arrested.

CCTVs placed near the accident spot show the BMW that has a Chandigarh registration number ramming into the motorcycle and consequently both the victims being flung into the air. A case has been registered in this connection under Sec 304 of the IPC.

The accused's father Amit Shah and other family members tried to convince investigators that their employee was driving the BMW on the night of Feb 24. However, police dismissed the claim as the version of eye-witnesses is completely different.

According to one of the witnesses Lalit Gupta, the person who got out of the BMW after the car hit the tree was not just well-dressed but he spoke fluent English too.

Joint Commissioner of Police (Sector-1) Ajay Tomar told newspersons that Vismay Shah has been arrested as the BMW is registered in his name. "Shah is the son of a local eye surgeon here. We are questioning him and will seek his remand for further custodial interrogation," Tomar said.

Shah faces the charge of culpable homicide not amounting to murder.
