Karunanidhi pining for Kani's release; bail plea in court

New Delhi, Oct 24: Looks like DMK MP Kanimozhi still wants to take leverage as a woman in front of the judiciary when her bail plea is up for hearing in the special CBI court today (Oct 24). The court had framed charges on all the 17 accused in the 2G spectrum scam. Kanimozhi has been charged for accepting bribes, criminal conspiracy to cheat the exchequer and criminal breach of trust.

With Kanimozhi's father and DMK Chief Karunanidhi extremely hopeful that Kani will get bail, he is in Delhi and is understood that he will leave the capital only after she is granted bail. Kanimozhi is likely to argue that since the charges have already been framed, she can be granted bail as per the Supreme Court order. She has been in jail since May 2011.

There are reports that say that the CBI is not likely to oppose Kanimozhi's bail plea. But the final decision remains with the Special CBI judge OP Saini. The other co-accused whose bail plea will also be considered on Monday will include that of Kalignar TV MD Sharat Kumar, Shahid Balwa's brother Asif Balwa, Cineyug's Karim Morani and Kusegaon realty's Rajeev Agarwal.

Lawyer Vijay Aggarwal has been quoted as saying, "Kanimozhi and other accused - my clients Asif Balwa, Rajiv agarwal, Chandolia, Shahid Balwa - for everyone, chances of getting bail has improved. Because there is sub-section 6 of Section 437, which says that if after the framing of the charges, within 60 days of the dates fixed for taking evidence if the trial is not concluded then the person should get mandatory bail and it is irrespective of the sections involved."

All the accused who have been framed charges had pleaded not guilty. Sources have claimed that they will appeal against the charges in the High Court.

Meanwhile, the DMK is strongly supporting Kanimozhi and said that they will fight the case legally till the very end. Karunanidhi and his wife and Kanimozhi's mother Rajathiammal had even met Sonia Gandhi and the PM to push for his daughter's bail. With the granting of bail, the primary focus for Karunanidhi at the moment, he is pulling all his strings to secure bail for Kanimozhi.
