HC turned down ACEU''s derecognition by Air India

New Delhi, Feb 7 (PTI) Derecognition of Air CorporationEmployees Union (ACEU) by Air India management, for going onstrike last year has been set aside by the Delhi High Courtwhich said it was done without following the due procedures.

A single-member bench of Justice S Muralidhar has setaside the decision of the national carrier management toderecognise ACEU after observing that principles of naturaljustice was not followed as the union was not provided anopportunity before taking any disciplinary action.

"This Court... holds that the impugned order dated26th May 2010 derecognising ACEU is bad in law as it waspassed without any show-cause notice to the petitioner ACEUand without affording the petitioner an opportunity of beingheard," the court said.

"Accordingly, the letter dated 26th May 2010 which is... insofar as it derecognises the ACEU is set aside," thecourt further added.

The High Court''s direction came on a petition filedby ACEU challenging Air India''s notice derecognising itfor going on strike last year.
