2G case; Swamy seeks continuance of complaint, accuses TN CM
New Delhi, Feb 5 (PTI) Janata Party chief SubramanianSwamy today strongly pleaded for continuance of his privatecomplaint in the 2G spectrum case before a Delhi court, whichasked him whether there can be "parallel proceedings" in acriminal case when CBI was taking action in the matter.
Swamy sought to claim that that his complaint coverswider canvas of "involvement" of Tamil Nadu Chief Minister KKruananidhi in the scam and national security.
He was responding to a pointed query of SpecialJudge Pradeep Chaddah as how parallel proceedings cancontinue on the same issue when "media reports" suggested thatCBI was probing the case and has also arrested former TelecomMinister A Raja and two top officials in the case.
"As per section 210 of the CrPC, when it appears tothe magistrate that the police (CBI) investigation is inprogress in relation to some matter, the complaint case,which is pending before him, then he must stop the proceedingsand call for reports," the court said while asking the agencyto file a detailed report on February 22.
Earlier, Swamy said "the scope of the privatecomplaint was much wider than what is being investigated uponby the CBI and as per my knowledge, the complaint alsoinvolves concerns of national security and involvement ofKarunanidhi."
The Janata Party leader said that he was intending tofile an application seeking impleading of the Tamil Nadu ChiefMinister as an accused in the case as there was sufficientevidence to that effect. .
