Legal reforms must have a rational base: Law Commission chief
Hyderabad, Feb 4 (PTI) Law Commissions should adopt aholistic approach and consider the pros and cons of anyproposed reforms in context of society and their practicalaspect, Law Commission Chairman P V Reddy said today.
"A rational, balanced and foresighted approach coupledwith lucid juristic analysis should form the course of lawreforms. A cool and dispassionate analysis and thinking intune with the constitutional values and larger societalinterest are the hallmarks of law reform process," he said.
The retired Supreme Court Judge was speaking afterinaugurating the biennial conference of the CommonwealthAssociation of Law Reform Agencies (CALRAs) here.
"A pedantic or a purely legalistic approach withoutregard to practical aspects and ground realities is notexpected of Law Reform Commissions (LRC)."
LRCs have to deal with complex socio-legal issueswhich arise in contemporary society and find a legal solutionto the formidable problems associated with administration ofjustice, Reddy emphasised.
The LRCs, especially in Commonwealth countries, haveplayed a significant role in shaping laws, he said. "Despiteother bodies involved in law reforms, LRCs are perceived moreeffective in playing a vital role in reforms."
He said LRCs have emerged as key players in impartinginstitutional guarantee for improved, refined and robust laws.
"LRCs have become a supporting mechanism in formingthe opinion and planning for the requisite legal changes," theLaw Commission chief maintained. (more) PTI VVKRSY
