Religious structure cannot be built on residential plot:Guj HC

Ahmedabad, Jan 17 (PTI) Gujarat high court has ruledthat ''religious'' building cannot be constructed on land meantfor residential purpose without permission from a competentauthority of the Municipal Corporation.

The order was passed by Justice R R Tripathi last weekwhile hearing a petition of one Jagdish Dave living inVasantkunj Society here, objecting to a trust usingresidential property in the society for religious purpose andconstructing a Jain temple on a plot in the same society.

Dave had moved High Court against Ratnayatri AradhanaBhavan Trust which was using sub-plot 42 of VasantkunjSociety, where the petitioner resides, as ''Aaradhana Bhavan''(prayer hall) and constructing Jain Temple over sub-plot 46 ofthe same society, without any permission or getting any plansanctioned from the AMC.

"The building which is constructed by obtaining thepermission for residential purpose, cannot be used as a''religious building'' unless requirements provided aresatisfied and permission is sought from the competentauthority of the Corporation," court observed in its order.
