Probe against Dinakaran likely to be delayed
New Delhi, Apr 25: In the wake of the appeal for reconstruction by the panel probing the land grabbing and graft charges againts Karnataka High Court Chief Justice PD Dinakaran, the probe into the matter may be delayed.
The Committee made the appeal following the elevation of Justice AR Dave to the Supreme Court.
As per the impeachement proceedings, the Committee probing the charges should consist of a sitting judge of the Supreme Court, the chief justice of a high court and an eminent jurist.
Currently, Committee constituted by the Rajya Sabha Chairman Hamid Ansari, comprises of justice VS Sirpurkar of the Supreme Court, justice AR Dave, chief justice of the Bombay High Court, and eminent jurist PP Rao.
However, the Committee in its meeting held at the residence of justice Sirpurkar, is said to have made a decision to write to Rajya Sabha chairperson for the reconstruction of the panel in the wake of Justice Dave's elevation to the Supreme Court.
The Committee was set up by Ansari following the submission of notice of motion for starting impeachment proceedings against justice Dinakaran by MPs from BJP, Left Parties, Samajwadi Party, Janata Dal (United), Akali Dal and AIADMK.
The Rajya Sabha Chairman admitted the motion on Dec 17, 2009.
As per the Constutional law, judges of the Supreme Court and the High Court can be removed from office only through impeachment in Parliament.
Justice Dinakaran has been alleged of corruption, land-grabbing, abuse of judicial office and disproportionate assets.
