Nothing illegal if teacher sleeps in staff room: SC

New Delhi, Nov 20 (UNI) The Supreme Court has dismissed a petition filed by a Chennai-based school against a Madras High Court order confirming the ruling of trial court that the services of a teacher cannot be terminated for sleeping in the staff room.

A bench comprising Justices B N Agarwal and G S Singhvi refused to entertain the appeal of Saint Joseph Anglo-Indian Institute and dismissed it at the time of mentioning, yesterday.

Services of Johnson, a school teacher were terminated by the school in 2001 when he was found sleeping in the staff room.

The teacher challenged the action of the school authorities in the court which held that the termination was illegal and ordered his reinstatement.

The school appealed to the High Court which dismissed it.

The school then approached the Supreme Court and the case was mentioned before the court for urgent hearing.

The Judges, however, heard the counsel for the institute and dismissed the petition.
