Appear in person, High Court to DM and Srinagar jail superintendent

Sriangar, Nov 12 (UNI) The Jammu and Kashmir High Court has directed District Magistrate (DM), Srinagar and Superintendent of police, central jail to appear in person in the court on next hearing on November 18 in connection with a case filed by Peoples Political Party (PPP) chairman Hilal Ahmad War, detained under Public Safety Act (PSA).

Mr War, who was arrested on July 26 at Maisuma for his alleged anti-national activities, has moved an application in the High Court seeking direction to state and its functionaries for referring him to All India Institute of Medical Sciences (AIIMS), New Delhi for treatment of his eye and kidney ailments.

The court said respondents were afforded opportunity to file objections to this application. They, it said, have opted not to respond to it.

The petitioners application is supported by certificates issued by government SMHS hospital which support his submission that he has been suffering from kidney stone and retinal detachment, the order said.

The court said it hardly needs to be emphasised that when a person is in the custody of the state, it is required to take requisite measures to ensure that proper treatment, if needed, is made available to him.

As the respondents have opted not to file response to his application, so it become necessary to call upon District Magistrate, Srinagar and Superintendent of police, central jail, Srinagar to appear in person to indicate the steps they had taken to discharge their obligation in providing requisite medical care to the petitioner.

The next hearing will be on November 18.
