HC seeks comments from CJM Allahabad
Allahabad, Nov 10 (UNI) The Allahabad High Court today directed its registrar to obtain comments on a contempt petition from the S B Pandey, the Chief Judicial Magistrate (CJM), Allahabad, within 10 days and place the same on record.
Justice Sanjay Misra passed this order on a contempt petition filed by one Geeta Devi, whose lawyer son was murdered on July 07, 2008 at her Alopibagh residence in Daraganj area here.
The mother had filed the contempt petition against S B Pandey, CJM Allahabad, who according to the petitioner failed to pass orders on an application moved by her under section 156(3) CrPC in the Court of the CJM for registration of an FIR under section 302 IPC.
The High Court on October 21, 2008 had passed an order in the case of petitioner, issuing directions to the CJM, Allahabad, to pass order on the next date fixed on the application under section 156 (3) CrPC. It was also directed that in case, report is not submitted by the office/in charge concerned of the police station Daraganj, then the CJM Allahabad shall take appropriate action against officer concerned in charge of the police station Daraganj,Allahabad.
The petitioner had said this order of the High Court was not complied with by the CJM Allahabad. The Court has directed to hear this case on November 17.
