HC directs principal secretary to file reply

Allahabad, Oct 1 (UNI) For making transfers against the policy decision of the government as well as against the Court directions, the Allahabad High Court today directed the Principal Secretary, Medical Health and Family Welfare, UP, to file his reply by October 20 failing which he shall have to appear in person before the Court on October 22.

The order has been passed by a two-Judges bench comprising Justices V M Sahai and Pankaj Mittal on a writ petition filed by Dr Mahendra Nath Yadav, Joint Director Medical and Health services, Varanasi, challenging his transfer from Varanasi to Lucknow by an order dated 26.08.08.

The petitioner has pleaded that as per policy decision of the state government an employee, who is going to retire within 2 years need not be transferred, but the petitioner whose retirement is due on April 30, 2009 has been transferred from Varanasi to Lucknow without any reason.

Granting time to file a counter the Court has stayed the transfer of the petitioner till April 30, 2009.
