Court defers hearing of BMW case

New Delhi, Sep 17: The Patiala House Court on Wednesday, Sep 17 deferred the hearing on the anticipatory bail plea of the main accused of the BMW hit and run case, Utsav Bhasin. The accused has been booked under Section 304 of IPC (culpable homicide not amounting to murder). "The reason for the deffering the hearing was the parties' failure to produce the order of the Delhi High Court", said Additional Sessions Judge Brijesh Garg, to whom the anticipatory bail application was marked.

"This court wants to see the observations of the High Court on the petition filed by Dr Rajender Singh, father of victim Anuj Singh," the judge said.

Investigating Officer A S Rawat, however, submitted before the court that he would file the order of the High Court passed on Tuesday, Sep 16.

During the hearing, Bhasin's counsel Ramesh Gupta said that Section 304 (culpable homicide not amounting to murder) was invoked by the police on their own and the High Court did not say anything in this regard.

The charges were filed based on a statement from Marikant Thakur, who survived the accident but lost his friend Anuj Singh.

A Delhi HC judge on Sunday, Sep 14 had instructed the police to seize Bhasin"s passport, who was likely to leave for Singapore to pursue his studies.
