SC sends notice to Gujarat questioning higher reservation

New Delhi, Jul 14 (UNI) The Supreme Court today issued notice to State of Gujarat on a petition filed by a candidate who failed to get admission in a medical science course due to 75 per cent reservation provided by the State government in professional and educational courses in the state.

The Supreme Court has fixed upper limit for reservation at 50 per cent while the State government has given reservation up to 75 per cent which includes 15 per cent reservation for NRI.

A bench comprising Chief Justice K G Balakrishnan and Justice P Sathasivam asked the petitioner Henil Yogendrakumar , ''Why do not you challenge the legislation ?'' In response, Counsel for the petitioner told the court that he had filed the petition in April while the legislation was enforced in May.

According to the petitioner the government had abolished the Common Entrance Test also which was part of single window admission sytstem. Moreover, the private unaided educational institutions had been denied the discretion to grant admission on merit.

The apex court will hear the petition on July 21.
