No accused can be handcuffed without court's permission
JAMMU, Jun 25 (UNI) A local court said no accused can be hand-cuffed without permission of the court.
In an application filed by Captain Chaitnaya facing trial in abetment to suicide case of his wife Capt Megha Razdan, the court yesterday ordered that it is settled proposition of law that no accused can be hand-cuffed without permission of the court.
Chief Judicial Magistrate (CJM) Jammu Y P Bourney observed and directed Chief Prosecuting Officer to ensure that this legal position is strictly adhere by police officials.
This direction has been passed in an application of Captain Chaitnaya seeking direction to the respondents to bring the applicant before the court without hand-cuff.
